2. Scope of Applications
These Terms apply to all ElcoLynx products, including but not limited to: BikeMate, RangeOps, LoadEm, and any future applications, features, or services provided under the ElcoLynx brand.
3. Intended Use and Disclaimer
ElcoLynx applications are designed as informational, tracking, record-keeping, and organizational tools only.
They do not provide professional advice of any kind, including but not limited to medical, fitness, training, safety, legal, mechanical, engineering, or financial advice.
4. User Responsibility
You are solely responsible for:
- The accuracy and completeness of any data you enter
- Your decisions, actions, and outcomes based on app data
- Verifying information against official or professional sources
- Compliance with all applicable laws, regulations, and safety standards
5. Safety and Risk Acknowledgement
Activities associated with ElcoLynx applications (such as cycling, shooting sports, mechanical work, or equipment use) may involve inherent risks. You acknowledge that you participate in such activities at your own risk and agree that ElcoLynx is not responsible for injuries, accidents, equipment damage, or loss.
6. GPS, Sensor, and Data Accuracy
Any data generated through GPS, sensors, or user input (including distance, speed, elevation, timing, or performance metrics) is approximate and may be inaccurate due to hardware limitations, environmental factors, or software constraints.
7. No Warranty
All applications and services are provided on an "as is" and "as available" basis. ElcoLynx makes no warranties, express or implied, including but not limited to fitness for a particular purpose, accuracy, reliability, availability, or error-free operation.
8. Limitation of Liability
To the maximum extent permitted by law, ElcoLynx (Pty) Ltd shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to:
- Personal injury or death
- Property or equipment damage
- Loss of data or profits
- Service interruptions or software errors
- Legal or regulatory consequences
9. Subscriptions, Purchases, and Ads
Some applications may include paid subscriptions, one-time purchases, or advertising. Pricing, billing, and renewal terms are disclosed at the time of purchase and managed through the applicable app store platform.
10. Data and Privacy
Use of ElcoLynx applications is also governed by our Privacy Policy. Please review it to understand how your data is collected, used, and stored.
11. Modifications to the Services
ElcoLynx reserves the right to modify, suspend, or discontinue any part of its applications or services at any time without notice.
12. Termination
We may suspend or terminate your access to the application at our discretion if you violate these Terms or misuse the service.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict-of-law principles.
